Adjusting urban land-use planning to reflect the spatial planning objectives
Urban land-use plans must be compiled and adjusted by municipalities on their own responsibility to reflect the spatial planning objectives .
The Joint Spatial Planning Department is responsible for ensuring that urban land-use plans have been adjusted to reflect the spatial planning objectives in the Federal States of Berlin and Brandenburg.
Enquiry about spatial planning objectives
Brandenburg municipalities and districts of the Federal State of Berlin that intend to compile, change, augment or repeal an urban land-use plan must notify the regionally responsible department of the Joint Spatial Planning Department at an early stage and by generally stating their planning intentions and must enquire about which spatial planning objectives govern the corresponding planning area. The Joint Spatial Planning Department will notify the municipality or district within a period of one month about the spatial planning objectives, principles and other requirements as well as provide further information that could be of relevance in compiling the plan where necessary.
The Joint Spatial Planning Department assesses the draft plan regarding compliance with the spatial planning objectives in the context of involving the authorities. The result of this assessment will be forwarded to the municipality or district by way of a spatial planning statement.
In parallel to enquiring with the GL, the municipalities involve also the respective affected regional planning association.
Articles 12 and 13 of the State Planning Treaty provide the basis for adjusting urban land-use plans in the Federal States of Berlin and Brandenburg to reflect the spatial planning objectives. Details regarding the adjustment of urban land-use planning to reflect the spatial planning objectives are governed in the Federal State of Brandenburg by the decree of the Minister for Infrastructure and Regional Planning from 10 August 2005. The spatial planning objectives are mandatory provisions and must be observed in the compilation of urban land-use plans. The principles and other requirements of spatial planning must be observed in the context of the assessment by the respective public agency authority.
